This chapter argues that American public policy discussions should follow the Jewish model — which encourages open, frank, and even heated debate within an atmosphere of mutual respect. It further argues that religious views should be part of the American public discussion. This is a departure from a long-standing belief in a strong wall of separation between church and state.

This chapter begins with a discussion of fundamental convictions of Judaism that affect Jewish approaches to moral issues at the beginning of life, and then considers Jewish views about preventing pregnancy through contraception and abortion, and, conversely, assisting those with infertility problems. The analysis is also used to discuss embryonic stem cell research and genetic testing.

: According to Jewish law, there is a clear obligation to try to heal, and this duty devolves upon both the physician and the society. Jewish sources make it clear that health care is not only an individual and familial responsibility, but also a communal one. This social aspect of health care manifests itself in Jewish law in two ways: first, no community is complete until it has the personnel (and, one assumes, the facilities) to provide health care; second, the (...) community must pay for the health care of those who cannot afford it as part of its provision for the poor. The community, in turn, must use its resources wisely, which is the moral basis within the Jewish tradition for some system of managed care. Objective: To develop an approach for seeking informed consent to examine tissues retained from a previous study of sudden infant death syndrome as part of a study on asthma, and to document responses and participation rate.Design: Pilot open-ended approach to 10 volunteer SIDS parents, followed by staged approach to seek consent from the target SIDS families for the asthma study.Participants: Parents of SIDS infants known to SIDS and Kids Victoria and parents of SIDS infants from the 1991–2 SIDS in Victoria (...) case–control study.Main outcomes: Qualitative responses of the piloted parents and study parents, and participation rates.Results: The pilot group responses were used to refine the written material to be provided. Of the 72 families for which contact details were available, 45 gave verbal consent for contact by the Victorian Institute of Forensic Medicine regarding the asthma study, three refused and 24 did not respond to two letters. Thirty-three completed consent forms, all positive for participation in the asthma study, giving a positive response rate of 73% .Conclusions: The use of postmortem tissue for research is acceptable to the next of kin when an approach is sensitive to their concerns and needs and is made by experienced counsellors from a familiar organisation. Despite the painful memories evoked by the approach of the research group, the acceptance rate among those who could be contacted was high. (shrink)

Each volume in the series presents hypothetical case studies involving modern moral questions, a collection of classical and contemporary sources relevant to the case studies, and a collection of short essays by a range of contemporary American Jews reflecting on these materials or on other related issues. Elliot Dorff and Louis Newman, the preeminent scholars of Jewish ethics who edited this first volume in the series, explain in their introduction that they sought to gather together “a variety of authors with many different Jewish beliefs and approaches” (xvi). They do not claim to present “what Judaism says,” but, rather, to anthologize a variety of Jewish perspectives. In doing so, they seek to follow the approach of the Bible and the Talmud, both of which contain “many, many voices articulating often diverse points of view” (xvi).On the other hand, Dorff and Newman reject the idea that “anything goes” when it comes to Jewish views about the body. They indicate that modern American Jews may be tempted to endorse such a perspective, accustomed as they are to the American notion that “I own my body.” But, Dorff and Newman suggest, American Jews would do well to consider the contrary notions that animate much of classical Jewish thought on the body: that God is the true owner of every human body, and that God makes demands about how one should use one’s body. The case studies that follow challenge readers to keep these ideas in mind as they consider duties to limit one’s body weight, refrain from tattooing one’s body, and avoid high-risk behaviors.The essays that make up the heart of this book do by and large embrace Dorff and Newman’s challenge. Consequentialism is the family of theories that holds that acts are morally right, wrong, or indifferent in virtue of their consequences. Less formally and more intuitively, right acts are those that produce good consequences. A consequentialist theory includes at least the following three elements: an account of the properties or states in virtue of which consequences make actions right, wrong, or indifferent; a deontic principle which specifies how or to what extent the properties or states must obtain in order for (...) an action to be right, wrong, or indifferent; and finally, a specification of what is in the domain of the deontic principle. For example, mental state and desire theories provide different accounts of the first element; maximizing and satisficing are distinct deontic principles; and Act and Rule Consequentialism specify different domains over which a deontic principle ranges. A wide range of alternative theories can be generated by modifying these three elements. For example, Hedonistic Act Utilitarianism which requires that each act maximize pleasure, and Perfectionist Lifetime Minimalism which requires that each life satisfy some minimal standard of perfection are both varieties of Consequentialsm. The conceptual space Consequentialism describes is vast, versions of Consequentialism vary radically in their plausibility, and few objections count against all versions of Consequentialism.
